RULES OF THE “15TH ANNIVERSARY OF GRZECHHAIR” COMPETITION

 

General Provisions

 

1. The organiser of the competition is Grzegorz Grzech GrzechHair, with its registered office in Gdynia, ul. Przebendowskich 49a, 81‑526 Gdynia, NIP 5882354581, REGON 221244679, hereinafter referred to as the “Organiser”

2. The competition is run via Instagram and TikTok. The competition is in no way sponsored, endorsed, administered by, or associated with Meta Platforms Ireland Limited or TikTok Technology Limited.

3. These platforms are not the controllers of Participants’ data, nor do they participate in the selection of winners.

4. The competition is organised within the territory of the Republic of Poland and conducted in Polish. Participants must have a public account on Instagram and TikTok for the entire duration of the competition and until the results are announced.

5. The competition runs from 18 May 2026 at 14:00 until 8 June 2026 at 14:00. The results will be announced by 15 June 2026.

6.  This competition is a competition within the meaning of these rules. The selection of winners is determined by the competition panel in accordance with the criteria set out in the rules. The competition does not involve any element of chance; it does not constitute a game of chance, a betting scheme or a promotional lottery within the meaning of the Gambling Act.

 

Definitions

 

1. ‘Competition post’ – a post published on the Organiser’s official profile @grzechhair_wlosy_doczepiane, containing the competition announcement and the rules for participation.

2. “Participant” – a natural person who is at least 18 years of age, has a public account on Instagram or TikTok, and meets all the conditions for participation set out in these rules.

3. “Competition Entry” – a comment under the Competition Post or a video (Reels/TikTok) posted by a Participant in accordance with § Rules of Participation, tagging the Organiser’s profile and containing the required hashtag.

4. “Competition Panel” – a panel of at least three members appointed by the Organiser, responsible for assessing Competition Entries, awarding points and selecting the winners in accordance with the criteria set out in these rules.

5. “Prize” – the reward provided for in § Prizes, awarded to Participants selected as winners of the competition.

 

Participants

 

1. Only natural persons who are aged 18 or over, have full legal capacity, and maintain a public and authentic Instagram or TikTok account throughout the duration of the competition and until the date of the announcement of the results may take part in the competition.

2. The following persons may not take part in the competition:

a) employees of the Organiser,

b) persons cooperating with the Organiser under civil law contracts,

c) members of the Organiser’s governing bodies,

d) persons directly involved in the preparation or running of the competition,

e) spouses, ascendants, descendants, siblings and persons living in the same household as the persons listed above.

3. Participation in the competition is voluntary and free of charge, subject to the usual costs of internet access incurred by the Participant in accordance with their provider’s tariff.

4. A Participant may only use one genuine account held in their own name. The use of fictitious, newly created, automated, purchased or third-party-managed accounts is prohibited.

5. The Participant declares that they are taking part in the competition in their own name and are not acting on behalf of third parties or as part of a group seeking to manipulate the results of the competition.

 

Rules of participation

 

1. To take part in the competition, the Participant must, during the competition period: 

● hold a public and genuine Instagram or TikTok account, operated in their own name, 

● complete the competition task, which involves answering the question: “Why should you be the one to win?” – either as a comment under the competition post on Instagram, 

or – in the form of a video (Reels/TikTok), tagging the profile @grzechhair_wlosy_doczepiane (Instagram) or @grzechhair (TikTok) and adding the hashtag #15LatGrzechHair. The entry must remain public and accessible until the results are announced and the prizes are awarded.

2. Competition entries must comply with the law, public decency, and the terms and conditions of Instagram and TikTok, and must not infringe the rights of third parties.

3. Entries must not contain any content that is unlawful, offensive, vulgar, discriminatory, or that infringes personal rights, copyright, image rights or trade secrets, nor any content that could expose the Organiser to liability.

4. Each participant may submit one entry. Should more than one entry be submitted, the Organiser will only consider the first one in chronological order.

5. The Organiser may exclude an entry which: 

● does not meet the formal requirements of these rules, 

● was submitted after the deadline, 

● breaches the law, Instagram’s or TikTok’s terms and conditions, or the rights of third parties, 

● has been submitted using fictitious, newly created, automated, purchased or third-party-managed accounts, or using tools designed to artificially increase reach, 

● has been generated, in whole or in part, using artificial intelligence (AI) tools, if this affects the creativity or originality of the entry, 

● has been hidden, deleted or modified after publication in a way that hinders evaluation.

 

 

 

 

 

 

 

Criteria for selecting winners

 

1. The competition jury will select 3 winners from among all valid competition entries.

2. The jury will assess entries according to the following criteria: 

  ● creativity – max. 5 points, 

originality – max. 5 points, 

relevance to the competition theme – max. 10 points.

3. The winners will be those participants whose entries receive the highest total number of points.

4. In the event of a tie, the panel shall select the winner on the basis of the higher score for the ‘relevance to the theme’ criterion. If the tie persists, the panel shall make its selection by unanimous decision, as recorded in the minutes.

5. The jury may decide not to award a prize if none of the entries meet the criteria set out in the rules or breach their provisions.

6. Minutes shall be drawn up of the committee’s proceedings, containing a list of the entries assessed, the marks awarded, the reasons for the selection of the winners and the signatures of the committee members. The minutes shall constitute the official record of the competition.

7. The decisions of the competition committee are final and cannot be appealed.

 

Prizes

 

1. The following prizes are available in the competition: 

1st place: A voucher worth 1,500 PLN to be used in the Organiser’s physical or online shop; 

2nd place: A one-off discount voucher offering 30% off purchases up to 2,000 zł; 

3rd place: A one-off discount voucher offering 15% off purchases up to 2,000 zł.

2. Vouchers and Discount Vouchers: 

● are valid for a single use only

● cannot be exchanged for cash or other benefits, 

● cannot be combined with other promotions, discounts or codes, unless the Organiser decides otherwise, 

● must be used within the period specified by the Organiser, which must be at least 30 days from the date of issue, 

● may only be redeemed by the winner and cannot be transferred to third parties.

3. If, in accordance with the applicable regulations, the awarding of the prize gives rise to an obligation to withhold a flat-rate income tax, the Organiser shall award an additional cash prize to cover the tax due and shall pay the tax as the withholding agent.

4. The Organiser shall inform the winner of any tax obligations before the prize is awarded.

5. The Organiser may refuse to award the prize in the event that: 

● the winner providing false or incomplete details, 

● a breach of the rules, 

● the winner deletes or conceals their entry before the prize is awarded, 

● it is found that the entry was made in breach of the law, the platform’s terms and conditions or the rights of third parties.

 

Announcement of results and contact details

 

1. The results of the competition will be published on the Organiser’s profile @grzechhair_wlosy_doczepiane in a post, story or comment by 

15 June 2026.

2. The Organiser may publish the winner’s username as used on Instagram or TikTok. Any other personal data will be published only to the extent permitted by law and in accordance with these terms and conditions.

3. The winner will also be notified of their win via a private message sent from the Organiser’s official account @grzechhair_wlosy_doczepiane. The participant is obliged to ensure that they can receive messages from other users.

4. The winner has 5 working days from the date the message is sent to provide the details necessary for the prize to be awarded. The Organiser may ask for confirmation of receipt of the message. Failure to reply within the specified time limit will result in forfeiture of the right to the prize, unless the Organiser decides otherwise.

5. Should the winner forfeit their right to the prize, the Organiser may award the prize to the next Participant on the ranking list or decide not to select a further winner.

6. The Organiser shall not be liable for any inability to contact the winner resulting from:

 ● restrictions on the account’s privacy settings, 

● an inactive account, 

● incorrect contact details, 

● technical issues on the part of the Participant or the platform.

 

Awarding the prize

 

1. The prize will be awarded within 14 working days of the Organiser receiving from the winner a complete set of details necessary for its award.

2. For the purposes of awarding the prize, the Organiser may only request the details necessary for delivery and settlement, in particular: first name, surname, delivery address, telephone number for the courier, email address and – where necessary – details required by tax regulations. The winner is obliged to provide true and up-to-date details.

3. The Organiser may ask the winner to submit the declaration referred to in the annex to these rules, in particular confirming that they have met the conditions for participation in the competition and are entitled to receive the prize.

4. The handover of the prize may be confirmed by a handover report, a courier delivery receipt or another document confirming receipt.

5. The Organiser may refuse to award the prize in the event that: 

● the winner provides false, incomplete or out-of-date details, 

● the winner fails to submit the required details within the timeframe specified in the rules, 

● the entry being deleted or hidden before the prize is awarded, 

● the winner breaches these terms and conditions or the law.

6. The Organiser shall not be liable for any delays in the delivery of the prize resulting from the actions of courier companies, errors in the address provided by the winner, or other causes beyond the Organiser’s control.

 

 

Complaints

 

1. Complaints regarding the conduct of the competition may be submitted within 14 days of the announcement of the results, by email to marketing@grzechhair.com or by post to the Organiser’s registered office. Complaints submitted after this deadline will not be considered.

2. A complaint must include at least the following: the Participant’s full name or username, contact details, a description of the concerns, the date of the incident and a specific request. The Organiser may request additional information if it is necessary to consider the complaint.

3. The Organiser shall consider the complaint within 14 days of receipt and shall respond to the address provided by the complainant. Failure to respond within this period shall constitute rejection of the complaint.

4. A response to the complaint will be provided electronically, unless the Participant specifies another method of contact. The Organiser’s decision regarding the complaint is final.

 

Copyright and image rights

 

1. The Participant declares that the Competition Entry is their own work or that they hold all the rights, consents and authorisations necessary for its submission to the competition, including copyright, related rights and the consents of persons appearing in the material (image rights).

2. The Participant bears full responsibility for any infringement of third parties’ rights, in particular copyright, related rights, personal rights, image rights and trade secrets. In the event of any claims being made against the Organiser, the Participant undertakes to indemnify the Organiser and to cover all costs associated therewith.

3. Upon submission of the competition entry, the Participant grants the Organiser a non-exclusive, royalty-free, territorially unlimited licence to use the entry solely for the purpose of: 

● conducting the competition, 

● the evaluation of Entries by the judging panel, 

● announcing the results, 

● presenting the Entries on the Organiser’s competition-related channels (Instagram, TikTok, website), within the scope of use necessary to achieve these purposes, in particular: 

a) recording and reproducing by any means, 

b) making them publicly available online, 

c) displaying and disseminating them on the Organiser’s social media channels.

4. The licence referred to in paragraph 3 also includes the right to make any necessary technical modifications to the Entry (e.g. cropping, compression, format adjustment), provided that this does not compromise its integrity.

5. Should the Organiser wish to use the winning Entry for purposes beyond the scope set out in paragraph 3 (e.g. in advertising campaigns, promotional materials, paid publications), a separate agreement with the Participant will be required.

6. The Organiser reserves the right to remove or disqualify any Entry that infringes the rights of third parties, the competition rules, the terms and conditions of the Instagram or TikTok platforms, public decency or the law.

7. Entries generated wholly or partly using artificial intelligence (AI) tools may be disqualified if they affect the assessment of creativity or originality, or breach the principles of fair competition.

 

Marketing Consent

 

1. Participation in the competition is not conditional upon giving marketing consent, subscribing to a newsletter, following a profile or performing any marketing-related action

2. If the Organiser intends to collect marketing consents, these must be given separately, voluntarily and may be withdrawn at any time.

3. Withdrawal of marketing consent does not affect the lawfulness of data processing carried out prior to its withdrawal, nor does it result in the loss of the right to a prize.

4. Failure to give marketing consent does not affect the ability to take part in the competition or the chances of winning.

 

Liability

 

1. The Organiser accepts no liability for any malfunction of Instagram, TikTok, the internet or Participants’ devices, nor for any technical limitations, interruptions, errors or failures beyond the Organiser’s control which prevent or hinder participation in the competition, the submission of an Entry or contact with the winner.

2. The Organiser shall not be liable for a Participant providing false, incomplete or out-of-date contact details, account privacy settings, the inability to receive messages, or any other circumstances preventing the award of the prize.

3. The Organiser shall not be liable for the acts or omissions of third parties, in particular courier companies, postal operators, internet service providers, social media platforms and entities for whose actions the Organiser is not liable under the law.

4. The Organiser shall not be liable for Entries that infringe the rights of third parties, including copyright, related rights, personal rights or the right to one’s own image. Full liability in this regard rests with the Participant.

5. The limitations of liability set out in these terms and conditions do not exclude the Organiser’s liability which cannot be excluded under mandatory provisions of law.

 

Final provisions

 

1. These Rules are available at [https://www.grzechhair.com/pl/content/regulamin-konkursu] throughout the duration of the competition and for at least 30 days after its conclusion.

2. In matters not covered by these rules, the provisions of Polish law shall apply, in particular the Civil Code and the legislation on the protection of personal data.

3. The competition does not constitute a game of chance, a betting scheme or a promotional lottery within the meaning of the Gambling Act, as the awarding of prizes is decided by the competition committee on the basis of merit-based criteria, rather than an element of chance.

4. The Organiser reserves the right to amend these rules during the course of the competition, provided that such amendments do not disadvantage the Participants. Information regarding any amendments to these rules will be published in the same manner as these rules were originally made available.

5. The annexes to these rules form an integral part thereof.

6. The rules and competition documentation, including the jury’s minutes, shall be retained by the Organiser for the period necessary to consider any complaints and to defend against any claims.

 

Information notice for competition participants

 

1. The controller of your personal data is Grzegorz Grzech GrzechHair, with its registered office in Gdynia, ul. Przebendowskich 49a, 81-526 Gdynia, email: marketing@grzechhair.com.

2. We process your personal data on the following legal basis: 

Article 6(1)(b) of the GDPR – for the purposes of organising the competition, verifying entries, selecting winners, contacting winners and awarding prizes, 

Article 6(1)(c) of the GDPR – for the purpose of fulfilling tax and accounting obligations, where applicable, 

Article 6(1)(f) of the GDPR – for the purposes of handling complaints, preventing fraud and defending against claims, 

Article 6(1)(a) of the GDPR – where separate marketing consent has been given.

3. If you give separate consent, we will also process your data for the purpose of sending marketing information regarding the Organiser’s own products or services via the specified communication channel. You may withdraw your consent at any time.

4. The recipients of the data may include entities providing the Organiser with technical, accounting, legal and courier support, as well as IT service providers. Instagram and TikTok act as separate data controllers in accordance with their own terms and conditions and privacy policies.

5. We retain participants’ data for the period necessary to run the competition, award prizes and deal with complaints, and subsequently for the period required to defend against claims and fulfil our legal obligations. We retain data processed on the basis of marketing consent until such consent is withdrawn or the purpose of processing ceases to apply.

6. You have the following rights: the right to access your data, to have it rectified, to have it erased, to restrict processing, to data portability, and to object – where the basis for processing is a legitimate interest – and the right to withdraw your consent at any time, without affecting the lawfulness of the processing carried out prior to its withdrawal. You also have the right to lodge a complaint with the President of the Office for Personal Data Protection.

7. The provision of data is voluntary; however, failure to provide data marked as essential may prevent you from taking part in the competition or receiving a prize.

8. The competition is in no way sponsored, endorsed or administered by Meta Platforms Ireland Limited or TikTok Technology Limited. These platforms are not the data controllers for Participants’ data in relation to the competition.
